This End-User License Agreement(EULA) is a legal agreement between you (either an individual or a single entity) and JR-Software for the software product JR-ActiveSizer, which includes computer software and may include associated media, printed materials, and "online" or electronic documentation(SOFTWARE) . By installing, copying, or otherwise using the SOFTWARE, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the SOFTWARE.
LICENSE
UNREGISTERED VERSION
This product is shareware and may be used for evaluation purposes at the user's own risk for a period of 30 days from the date of installation. At the end of this period, the user must either purchase a license to continue using the software, or remove it from his/her system. The unregistered version of this software shows an About Box occasionally at startup with information on how to order and register the software. This About Box is NOT SHOWN in the registered version.Software developed using the unregistered version must not be distributed to end-users for profit or otherwise, except so far as this is for educational or demonstration purposes in a program developed specifically for the purpose of demonstrating the functionality of this software.
REGISTERED VERSION
On payment of the appropriate license fee, the user is entitled to use a single copy of the software for development purposes for each license purchased. The license is granted per developer, which means that it is permissible for the same developer to install more than one copy of the software provided that only one copy is in use at any time. A royalty-free license is also granted for unlimited installation of the software on end-users systems. This license covers the installation of the control necessary for any application which uses this software to function properly. UNDER NO CIRCUMSTANCES IS IT PERMISSIBLE FOR THE UNLOCK CODE FOR THIS SOFTWARE TO BE MADE KNOWN TO END USERS.
DISTRIBUTION
Nonprofit distribution of the unregistered version of the SOFTWARE is permissible on condition that the SOFTWARE is not altered in any way and is distributed in its entirety. Electronic transfer, renting, leasing, loaning, selling or distributing of the SOFTWARE for profit in any form, including but not limited to bulletin board distribution, magnetic or optical medium distribution is not permitted without the consent of JR-Software.
Distribution of the registered version of the SOFTWARE is not permissible for any purpose.
RESTRICTIONS
The evaluator/user/buyer/owner is not allowed to attempt to reverse engineer, disassemble or decompile the SOFTWARE. You may permanently transfer all of your rights under this EULA, provided the recipient agrees to the terms of this EULA.
WARRANTY
JR-Software expressly disclaims any warranty for the SOFTWARE. THE SOFTWARE AND ANY RELATED DOCUMENTATION IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OR MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT. THE ENTIRE RISK ARISING OUT OF USE OR PERFORMANCE OF THE SOFTWARE REMAINS WITH YOU.
LIABILITY
The evaluator/user/buyer/owner of the SOFTWARE will indemnify, hold harmless, and defend JR-Software against lawsuits, claims, costs associated with defense or accusations that result from the use of SOFTWARE. JR-Software is not responsible for any damages whatsoever, including loss of information, interruption of business, personal injury and/or any damage or consequential damage without limitation, incurred before, during or after the use of the SOFTWARE.
The SOFTWARE is supplied subject to the condition that the user undertakes to evaluate its suitability for his/her purposes. JR-Software makes no representation of the software's suitability for any purpose.
